About the present Terms of Service

This End User Agreement (the ‘Agreement’) should be read by you (the ‘User’ or ‘you’) in its entirety before using Cryptoplay’s services or products. Please note that this Agreement constitutes a legally binding contract between you and Cryptoplay (referred to herein as ‘Cryptoplay’, ‘us’, or ‘we’), which owns and operates the website and games available at www.Cryptoplay.io (the ‘Service’). By clicking the ‘I Agree’ button, where provided, and/or by using the Service, you acknowledge and consent to the terms and conditions set forth in this Agreement.

1. Grant of License

Subject to the terms and conditions set forth herein, Cryptoplay grants the User a non-exclusive, personal, non-transferable right to use the Service on the User’s personal computer or other Internet-enabled devices in order to access the games made available on the Cryptoplay.io website (the website and games collectively referred to as the ‘Service’).

The Service may not be used by: (i) individuals under 18 years of age; (ii) individuals under the legal age of majority in their jurisdiction; or (iii) individuals accessing the Service from jurisdictions in which such access is unlawful. Cryptoplay is unable to verify the legality of the Service in every jurisdiction, and it is therefore the User’s responsibility to ensure that their use of the Service complies with applicable laws.

Cryptoplay and its licensors are the sole owners of all rights in and to the Service, including its code, structure, and organization, as well as all copyrights, trade secrets, intellectual property rights, and other proprietary rights. Subject to applicable laws, the User may not: (a) copy, distribute, publish, reverse engineer, decompile, disassemble, modify, or translate the website; or (b) use the Service in any manner prohibited by applicable laws or regulations (each of the foregoing constituting an ‘Unauthorized Use’).

Cryptoplay reserves all rights not expressly granted to the User under this Agreement and retains full ownership, title, and interest in and to the Service. The User agrees to be solely liable for any damages, costs, or expenses arising from or related to any Unauthorized Use committed by them. The User shall promptly notify Cryptoplay upon becoming aware of any Unauthorized Use by any person and shall provide reasonable assistance in any resulting investigation conducted by Cryptoplay.

The name ‘Cryptoplay,’ its domain names, and any trademarks or service marks used by Cryptoplay in connection with the Service (the ‘Trade Marks’) are the exclusive property of Cryptoplay. In addition, all content on the website—including, without limitation, images, graphics, photographs, animations, videos, music, audio, and text (the ‘Site Content’)—belongs to Cryptoplay and is protected by copyright and other intellectual property rights.

By using the Service, the User acknowledges that they acquire no rights in the Site Content and/or the Trade Marks, or any part thereof. The Site Content and the Trade Marks may not be used under any circumstances without Cryptoplay’s prior written consent. The User further agrees not to take any action that may harm or potentially harm Cryptoplay’s rights, including its intellectual property rights.

2. No Warranties

Cryptoplay disclaims all warranties, express or implied, in connection with the Service, which is provided to you on an ‘as is’ basis. We make no warranties or representations of any kind regarding the quality, fitness for purpose, completeness, or accuracy of the Service. Despite Cryptoplay’s efforts, we do not warrant that the Service will be uninterrupted, timely, or error-free, nor that any defects will be corrected.

Funds deposited into your Cryptoplay account will be held separately from our operational funds. However, in the event of insolvency, we do not guarantee that such deposited funds will be treated as separate from our other assets, and we make no guarantee that all or any portion of your funds will be returned to you. Cryptoplay is not a financial institution, and funds deposited into your Cryptoplay account are not insured by any governmental agency or protected by any deposit protection scheme, nor will they accrue interest.

Any amounts owed by you to Cryptoplay under these Terms may be deducted, in whole or in part, from the funds held in your Cryptoplay account, without prior notice.

3. Authority/Terms of Service

You agree to abide by the game rules published on the Cryptoplay.io website. Cryptoplay retains full authority over the issuance, maintenance, and termination of the Service. All decisions made by Cryptoplay’s management regarding the use of the Service or the resolution of any disputes are final and not subject to review or appeal.

4. Your Representations and Authorities

Your Representations and Authorities

Before your use of the Service and on an ongoing basis, you represent, warrant, covenant, and agree that:

• Your use of the Service is at your sole option, discretion, and risk;
• You are solely responsible for any applicable taxes which may be payable on cryptocurrency awarded to you through your use of the Service;
• The telecommunications networks and Internet access services required for you to access and use the Service are entirely beyond the control of Cryptoplay, and Cryptoplay shall have no liability whatsoever for any outages, slowness, capacity constraints, or other deficiencies affecting the same;

You also agree that:

• (i) You are aged 18 or over;
• (ii) You are of legal age of majority in your jurisdiction;
• (iii) You are accessing the Service from a jurisdiction in which it is legal to do so;
• (iv) You are not currently self-excluded from any gambling site or gambling premises, and you will inform Cryptoplay immediately if you enter into a self-exclusion agreement with any gambling provider.

5. Risk Disclosure

You agree and understand that there are risks associated with utilizing services involving digital currencies, including but not limited to: the risk of failure of hardware, software, and Internet connections, and the risk of malicious software introduction. You acknowledge that Cryptoplay shall not be responsible for any communication failures, disruptions, errors, distortions, or delays you may experience when using the Services, howsoever caused.

The risk of loss when using services involving digital currencies may be substantial, and losses may occur over a short period of time. In addition, price and liquidity are subject to significant fluctuations that may be unpredictable.

6. Prohibited Uses

PERSONAL USE. The Service is intended solely for the User’s personal use. The User is only allowed to wager for his/her entertainment, and any form of collusion or abuse of the Service is strictly prohibited.

AML & SANCTIONS COMPLIANCE. Cryptoplay expressly prohibits and rejects the use of the Service for any form of illicit activity, including money laundering, terrorist financing, or trade sanctions violations, consistent with various jurisdictions’ laws, regulations, and norms.

8. Restrictions

The User shall be forbidden:

• To give access to the account to any third parties;
• To make any User’s login and password details available to the public;
• To exploit any vulnerabilities in cryptocurrencies;
• To spread false information about CryptoPlay on external resources (forums, blogs, social networks);
• To engage in any form of farming, regardless of the method used.

9. Account termination

Account termination

We reserve the right to immediately suspend, freeze, or terminate your account if you:

• Impersonate CryptoPlay's staff or other users;
• Are suspected of exploit abuse;
• Manipulate the outcome of bets;
• Engage in illegal activity;
• Abuse bug(s);
• Sell account(s);
• Exploit any vulnerabilities in digital currencies;
• Spread any false information about CryptoPlay.

10. Breach

Without prejudice to any other rights, if a User breaches, in whole or in part, any provision contained herein, Cryptoplay reserves the right to take such action as it sees fit, including terminating this Agreement or any other agreement in place with the User and/or taking legal action against such User. You agree to fully indemnify, defend, and hold harmless Cryptoplay and its shareholders, directors, agents, and employees from and against all claims, demands, liabilities, damages, losses, costs, and expenses, including legal fees and any other charges whatsoever, howsoever caused, which may arise as a result of (i) your breach of this Agreement, in whole or in part; (ii) violation by you of any law or any third-party rights; and (iii) your use of the Service.

11. Limitations of Liability

Under no circumstances, including negligence, shall Cryptoplay be liable for any special, incidental, direct, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use (or misuse) of the Service, even if Cryptoplay had prior knowledge of the possibility of such damages. Nothing in this Agreement shall exclude or limit Cryptoplay’s liability for death or personal injury resulting from its negligence.

12. Disputes

If a User wishes to make a complaint, please contact Cryptoplay’s customer service team at [email protected]. Should any dispute not be resolved to your satisfaction you may pursue remedies in the governing law jurisdiction set forth below.

13. Amendment

Amendment

Cryptoplay reserves the right to update or modify this Agreement or any part thereof at any time or otherwise change the Service without notice, and you will be bound by such amended Agreement upon posting. Therefore, we encourage you to check the terms and conditions contained in the version of the Agreement in force at such time. Your continued use of the Service shall be deemed to attest to your agreement to any amendments to the Agreement.

14. Severability

Severability

If a provision of this Agreement is or becomes illegal, invalid, or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision hereof or the validity or enforceability in other jurisdictions of that or any other provision hereof.

15. Assignment

Cryptoplay reserves the right to assign this Agreement, in whole or in part, at any time without notice. The User may not assign any of his/her rights or obligations under this Agreement.

16. Miscellaneous

Miscellaneous

No waiver by Cryptoplay of any breach of any provision of this Agreement (including the failure of Cryptoplay to require strict and literal performance of or compliance with any provision of this Agreement) shall in any way be construed as a waiver of any subsequent breach of such provision or of any breach of any other provision of this Agreement. Nothing in this Agreement shall create or confer any rights or other benefits in favour of any third parties not party to this Agreement. Nothing in this Agreement shall create or be deemed to create a partnership, agency, trust arrangement, fiduciary relationship or joint venture between you and Cryptoplay. This Agreement constitutes the entire understanding and agreement between you and Cryptoplay regarding the Service and supersedes any prior agreement, understanding, or arrangement between you and Cryptoplay.

17. Updates to this Agreement

We may update or make changes to the content of this Agreement at any time, thus you agree to regularly read it and familiarize yourself with its terms. Any changes are effective when we post the revised Agreement on our website.
